TERMS AND CONDITIONS

1.        Payment on credit terms

1.1     This clause applies if, at the time you submit your Order, we have agreed to supply goods or services to you on credit terms

1.2     This clause applies subject to the terms of any agreement we have with you to supply goods and services on credit.  Where there is inconsistency between this clause and our credit terms, the credit terms will prevail to the extent of that inconsistency.

1.3     All payments (inclusive of GST and any freight charges that apply pursuant to these terms) are required at time of ordering.

1.4     Payments may be made by Electronic Funds Transfer (EFT), credit card Note:   We only accept Visa, and MasterCard credit cards or Paypal.

2. RIGHT TO CANCEL ORDER

2.1  You may cancel your Order, and terminate your contract with us, by sending us a Written Notice to that effect,  but only if:

2.1.1  your Order does not require us to source the Products especially for you; and

2.1.2   we have not yet Dispatched the Products to you and the order was placed within the last 28 days.

2.2  We may cancel your Order, and terminate your contract with us, by sending you a Written Notice, if you have  breached these Terms in anyway

3.  INSPECTION AND RETURNS

3.1  This clause has effect subject to any contrary law that is not otherwise excluded by these Terms.

3.2  You must inspect the Products as soon as is reasonably practicable after delivery.

3.3  If any or all of the Products delivered were damaged, defective, or incorrect when delivered, then you must give us Written Notice of that fact within 3 Business Days after the Delivery Date

3.4   If you provide Written Notice in accordance with sub-clause ‎3.3 above, we may require you to return the relevant Products to us for our inspection.  If we require you to do so, then we will reimburse you for your reasonable costs of returning them only if we later agree that the relevant Products were damaged, defective or incorrect

3.5  If you provide Written Notice in accordance with sub-clause ‎3.3 above, and you establish to our reasonable satisfaction that any or all of the relevant Products were delivered in a damaged or defective condition, your sole remedy shall be limited (as we may elect) to us offering to:

3.5.1  replace the relevant Products; or

3.5.2  refund to you of the purchase price by the issue of a credit note or a credit card account refund against return of the Products

3.6  If you provide Written Notice in accordance with sub-clause ‎3.3 above, and you establish to our reasonable satisfaction that we delivered the incorrect Product to you, then we will offer to replace that Product with the correct Product at our cost

3.7  If we offer to give you a refund or replacement under either sub-clause ‎3.5 or ‎3.6 above, then you must accept  that offer by returning the relevant Product/s to us in their original condition and packaging.  If yo do not do so, then we may revoke our offer of a replacement or refund by giving you Written Notice of that revocation

3.8  If you fail to give Written Notice in accordance with sub-clause ‎8.3 above, the Products shall be conclusively presumed to be in all respects in accordance with your Order and free from any defects that would be apparent on reasonable examination, and you shall be deemed to have accepted the Products accordingly.

3.9  Regardless of anything otherwise provided for in this clause ‎8, if you have an issue with Products that we sourced specifically for you, we will only accept returns if those specifically sourced Products are defective.

3.10  Any warranty claims for defective Products will be dealt with in accordance with the manufacturers policy or applicable  legislation.

4.  EXCLUSION OF LIABILITY

4.1  We warrant to you that all Products are approved for sale in Australia and/or New Zealand.  Save where otherwise expressly provided these Terms, or implied by legislation not excluded by these Terms, we give you no other warranty as to any quality or condition of Products delivered to you.

4.2    To the extent permitted by law, any condition or warranty that may be implied or otherwise read into this contract (including, with out limitation, any condition or warranty imposed by the Sale of Goods Act 1895 (WA) and it's equivalents in other jurisdictions) is hereby excluded.

4.3   Regardless of such exclusion, if you are a consumer within the meaning of the Australian Consumer Law then you may still be entitled to the benefit of consumer guarantees imposed under that legislation

4.4    If such legislation applies then, to the extent possible, we limit our liability in respect of any claim to, at our option:

4.4.1  in the case of goods:

(a)  the replacement of the goods or the supply of equivalent goods; 

(b)  the repair of the goods;

(c)  the payment of the cost of replacing the goods or of acquiring equivalent goods; or

(d)  the payment of having the goods repaired, and

4.4.2   in the case of services:

(a)  the supply of the services again; or

(b)  the payment of the cost of having the services supplied again.

INDEMNITIES

5.1  You will indemnify and keep indemnified us, and our employees, agents and contractors (“Our Indemnified Parties”) against all claims, expenses, losses, damages and costs (“Liabilities”) (including all Liabilities arising as a result of damage to a third party’s property or injury to or death of any person, and all legal costs in relation to any Liabilities) sustained or incurred by any of Our Indemnified Parties arising from:

a) any breach of these Standard Terms by the You;

b) any breach by you of the terms of any agreement with us where these Standard Terms are incorporated in that Agreement;

c) any negligent or wrongful act or omission of Yours or any of Your employees, agents or contractors in the course of or related to the performance of, or failure to perform, any obligations of the Yours under these Standard Terms; or

d) any fraud, dishonesty, misrepresentation or willful default of Yours.

SERVICING

6.1  Each service will be performed promptly, with due diligence, care and skill, by appropriately trained, experienced and supervised persons and to the best industry standards and be fit for the expected purpose;

6.2  If there is a leak from the water filter system since service was carried out, you have 14 days to contact us to rectify the issue.

6.3  Failure to contact us within 14 days from service will incur extra fees to rectify the issue with the filter system.
